Supreme court reschedules hearing of Ihedioha, Yari's application to March 2

The Supreme court has fixed March 2, 2020, for hearing the application filed by Emeka Ihedioha, ex-Imo state Governor and the Abdul’aziz Yari faction of the All Progressives Congress in Zamfara State, respectively.

Ihedioha asked the apex court to upturn the judgment it delivered against him last month which nullified his election as Imo governor and declared Hope Uzodimma of the All Progressive Congress as the winner of the March 9 governorship election in the state.

The seven-man panel of the court led by Chief Justice of Nigeria, Justice Tanko Muhammad decided to adjourn the hearing after Ihedioha’s lawyer, Chief Kanu Agabi (SAN), told the court that processes were still being filed.

“My lords, processes are still coming in. Up till this morning, we were still receiving processes. We, therefore, apply for an adjournment to enable all the processes to come in,” Agabi said.

The lawyer representing Uzodinma and his party, the All Progressives Congress, Damian Dodo (SAN), and that of the Independent National Electoral Commission, Taminu Inuwa (SAN), did not oppose the application for adjournment.

In a similar vein, APC Candidate for Zamafara state, Abdul’aziz Yari is seeking a review of the court’s May 24, 2019 judgment, which voided the participation of candidates of the APC in the last elections in the state.



Chief Justice of Nigeria (CJN), Tanko Muhammad who led a five-man panel of the court, said it was impossible for the court to proceed to hearing because some of the parties have not been served.

Lawyer to the Yari faction, Robert Clarke (SAN), lawyer to the Senator Gabiru Marafa faction of the APC in Zamfara, Mike Ozekhome (SAN) and lawyer to INEC, Tanimu Inuwa (SAN) agreed that an adjournment was necessary.
