A Kaduna State Chief Magistrates’ Court on Wednesday ordered that a 30-year-old petty trader, Auwal Sani, be remanded for allegedly defiling a 13-year-old daughter of his neighbour, pending legal advice.
The News Agency of Nigeria reports that Magistrate Hajara Dauda, who did not take the plea of the defendant, ordered the police to send back the case file to the office of the State Director of Public Prosecutions (DPP).
She said “Because of the sensitivity of the case, it is difficult to grant bail. The case file should be duplicated and sent to the Office of the DPP for advice.”
She adjourned the case until Sept. 23, for mention.
Sani, who resides at Zango Road Tundu Wada, Kaduna State, is facing one count charge of rape.
The prosecution counsel, Insp. Sunday Baba, told the court that the complainant, Albashir Salihu, who lives in the same street as the defendant reported the case at Police Division Tudun Wada on Aug. 23.
Baba said about 4 p.m., the defendant deceived and lured the complainant’s 13-year-old daughter into his room and allegedly raped her.
The defendant, he added gave the minor N100 and warned her not to tell anybody.
He said the offence contravened the provision of Section 258 of the Kaduna State Penal Code Law 2017.
