Court remands 65-year-old, four others over alleged threat to kill

An Ile-Ife Magistrates’ Court in Osun on Thursday remanded one Francis Awosikunle,65; Awofisayo Timothy,45; Tope Makinde,25; Adedayo Olalekan,32 and Balogun Sunday, 45, over alleged threat to kill.

Magistrate Joseph Owolawi refused the bail of the defendants but ordered that they should be remanded at the Ile-Ife Correctional Centre.

Owolawi adjourned the case until Dec. 19 for hearing.

The defendants are facing a three-count charge of conspiracy, assault occasioning harm and threat to lives.

Earlier, the prosecutor, Insp. Monday Ojiezele had told the court that the defendants committed the offences on Dec.11 at 10.00 a.m. at Apoje Village Junction in Ile-Ife.

Ojiezele said that the defendants conspired together to commit felony to wit: assault occasioning harm and threat to life with violence.

He said that the defendants threatened to kill: Baale Bamimosun Fabunmi, Okanlawon Arokoola, Ibrahim Taliatu, Emese Oluwasegun Adeyeba, Agunbiade Emmanuel, Odedoyin Mojoyin and Babatunde Elugbadebo, with a gun, cutlasses and planks.

According to Ojiezele, the defendants assaulted Baale Bamimosun Fabunmi, Okanlawon Arokoola, Ibrahim Taliatu, Emese Oluwasegun Adeyeba, Agunbiade Emmanuel, Odedoyin Mojoyin and Babatunde Elugbadebo, caused them bruises and open injuries on their bodies.

The prosecutor said that the offences contravened Sections 86, 355 and 517 (A) of the Criminal Code, Laws of Osun, 2002.

The defendants pleaded not guilty to the three-count charge of conspiracy, assault occasioning harm and threat to lives preferred against them.

Their counsel, Mr Ben Adidieje, applied for their bail in most liberal terms.

He promised the court that his clients would not jump bail and would provide substantial sureties.
