The Supreme Court led by Justice Okoro has said that the non-transmission on IReV did not affect the outcome of presidential election results.

In his reading of the judgment, Justice Okoro stated that the testimonies of Atiku and Obi’s state collation officers are merely hearsays.

According to him, it was impossible for the testifiers to be in all parts of their states at the same time to prove their case that there was electoral fraud.

Speaking on the 25 per cent requirement of the Federal Capital Territory, FCT, the Supreme Court upheld the Appeal Court’s ruling, adding that the decision of the Appeal Court is unassailable.

On the petition seeking to nullify Tinubu’s election on non-compliance with the electronic transmission of results, the Supreme Court ruled:

a. When IREV fails, it does not stop the collation of results

b. The non-function of IREV does not reduce voters’ confidence

Justice Okoro in his reading said, Atiku’s attempt to introduce fresh evidence with a view to extend the time to adjudicate the case is unfortunate as the PDP's flagbearer failed to convince the Supreme Court why he waited until the PEPC concluded the appellant’s suit.

The Justice noted that Atiku’s lawyers were tardy and not diligent in obtaining the documents from CSU, and as a result, the application is hereby dismissed and refused.
