Appeal Court affirms Adeleke as Osun Governor

The Court of Appeal has vacated the tribunal judgement that nullified the election of Governor Ademola Adeleke of Osun State in Abuja, on Friday.

The three-member panel of Justices, held that the appeal Ademola Adeleke filed to challenge his removal by the Osun State Governorship Election Petition Tribunal, was of merit.

The court, in its lead judgement, delivered by Justice Mohammed Lawal, awarded N500, 000 cost against the All Progressive Congress, APC, and its candidate, Gboyega Oyetola.

On July 16 the Independen National Electoral Commission declared Ademola Adeleke of the Peoples Democratic Party, as the winner of the governorship election.

He beat his contender, Gboyega Oyetola with a total of 403,371 votes.

Mr Oyetola, the immediate past governor of the state, claimed that the election was characterized by over-voting in 749 polling units and filed a petition to annulled the result declared by INEC.

According to reports, the tribunal led by Justice Terste Kume, directed INEC to withdraw the certificate of return issued to Adeleke and his deputy, Kola Adewusi, whom had been sworn into office and issued to Oyetola.

Adeleke petitioned the appeal court and victory was awarded to him again.
