Again, Court orders EFCC to release Emefiele immediately

The suspended Governor of the Central Bank of Nigeria, Godwin Emefiele, has been arrested by the Operatives of the Department of State Services, DSS.

Justice Olukayode Adeniyi of the High Court, Federal Capital Territory (FCT), sitting at Maitama, Abuja, on Monday, reiterated his earlier order directing the Economic and Financial Crimes Commission (EFCC) to immediately release former Central Bank of Nigeria (CBN) Governor, Godwin Emefiele, or bring him before the court to be granted bail.

The judge had on November 2 given the order and adjourned hearing of Emefiele’s enforcement of fundamental right to today.

The embattled former CBN governor had joined the Federal Government, Attorney-General of the Federation (AGF); Executive Chairman, EFCC and the anti-corruption commission as respondents in the case.

However, at the resumed hearing of the case, counsel for Emefiele, Mathew Burkaa SAN, informed the court that the third and fourth respondents had yet to comply with the court’s order.

According to the senior advocate, as of today, the applicant had spent 149 days in the custody of the respondents.

Counsel for the third and fourth respondents, Farouk Abdullah, confirmed to the court that they received the court order.

He told the court that the applicant’s processes were served on them and he wanted to respond with a view to setting the record straight but could not do so due to the fact that the processes were incomplete.

According to him, the affidavit filed by the applicant showed that certain exhibit referred to, particularly Exhibit B, which he said was referred to in Paragraph 20 of the affidavit, was not attached.
